Transnational Litigation and Commercial Arbitration is a case-oriented study of the key rules and procedures that regulate the resolution of commercial disputes arising in a transnational context. The study explains and compares European and American rules of private international and procedural law. Each main case is introduced both by a paradigm model, emphasizing and simplifying the key operative facts, as well as by a doctrinal presentation of the main issues and sources of American, European, or international law concerned. The court decisions themselves are all extensively edited and annotated by the authors. This 4th Edition, which has been completely revised and updated, takes account of recent developments in American law, including recent Supreme Court decisions on the exercise of juridical jurisdiction, and European law, including the Brussels I Regulation recast, effective within the European Union as of 2015. Transnational Litigation and Commercial Arbitration is suitable for use in upper-level courses in American, European, and Comparative Law. It also serves as a useful reference for practitioners.

Voldgiftsloven trådte i kraft 1. juli 2005, hvilket er mere end 10 år siden. På trods af voldgiftslovens vigtighed for danske virksomheder, er der ikke tidligere udarbejdet en lovkommentar på området. Denne kommenterede voldgiftlov er derfor helt unik og den første af sin art i Danmark. Lovkommentaren indeholder en gennemgang og analyse af voldgiftslovens enkelte bestemmelser. Vægten er lagt på retspraksis. De enkelte paragraffer er kommenteret på baggrund af mere end 500 retsafgørelser fra særligt de tre nordiske lande Danmark, Sverige, Norge, men også England, som er en helt central jurisdiktion for voldgift. Endvidere er der henvisninger til ca. 50 danske voldgiftskendelser. Der er i vidt omfang anvendt citater fra afgørelsens præmisser med henblik på bedre at anskueliggøre domstolens overvejelser og for at gøre fremstillingen mere praktisk anvendelig. Lovkommentaren er uundværlig for alle, der beskæftiger sig med voldgift.

The aim of the book is to give an easily accessible presentation of arbitration in Denmark. The book is based on the Danish Arbitration Act 2005 (which is based on the UNCITRAL model Law) and the Rules of Arbitration Procedure of the Danish Institute of Arbitration, with the main emphasis on the latter. It is the intention that the book will serve as an introduction, especially for non-Danish lawyers and their clients who are or who expect to become involved in arbitration proceedings in Denmark. The book is also helpful for non-Danish lawyers and companies who are considering to enter into an arbitration agreement that requires that the place of arbitration is in Denmark. Finally, the book is useful to those who are appointed as arbitrators in international arbitration proceedings in Denmark. The authors are specialists in this field with substantial experience in domestic and international arbitration. Published with support from Dreyers Fond.

Bogen tager sit naturlige udgangspunkt i Voldgiftsinstituttets regler for behandling af voldgiftssager (2008). For at illustrere og perspektivere reg-lerne vil der kunne findes adskillige henvisninger til voldgiftsloven, andre voldgiftsinstitutioners regler samt relevant domspraksis mv.
